Malpractice means negligent or improper behavior by a doctor who has failed to follow the acceptable standards of the medical profession.

Signing a physician's consent form does not waive your right to standard medical procedures and care.

What kinds of negligence are malpractice?

Here are some of the reasons you can file a malpractice suit:

  • Medication errors

  • Improper diagnosis

  • Failure to diagnose

  • Failure to advise of diagnosis

  • Lack of informed consent

  • Abandonment

  • Making a mistake during surgery

  • Medical instruments left inside the patient after surge

Medical malpractice law differs from state to state. So, it’s usually best to contact an attorney within the state where you claim the malpractice occurred.

What can I sue for?

In a medical malpractice case, you sue for damages. There are two kinds:

One is called ‘actual damages’ and includes the cost of your treatment, your lost wages and future wages, and compensation for your pain and suffering.

The other is ‘punitive damages’, which can be awarded when the doctor has been reckless or the negligence of the doctor is willful.
